 Usage Agreement & Liability Disclaimer

Alpha International Software Development LLC

1. Scope of Agreement

This agreement applies to all tuning files, software modifications, and services provided by Alpha International Software Development LLC, whether delivered via email, download, USB, or through our client portal.

2. Intended Use Only

All files and software services are provided exclusively for:

  • Motorsport purposes on closed circuits
  • Export vehicles not registered within the EU
  • Testing, development, or research environments

Use of these files in vehicles operated on public roads is strictly prohibited unless officially approved via individual homologation or certification by local authorities.

3. Customer Responsibility

The customer is solely responsible for:

  • The proper use of the software and tuning files
  • Ensuring full compliance with all applicable laws and regulations in their country or region
  • Any consequences related to changes in emissions, diagnostics, or type approval
  • Legal and technical outcomes if the software is used in public traffic or contrary to this agreement

Alpha International Software Development LLC accepts no liability for misuse, incorrect application, or legal consequences arising from unauthorized use.

4. Emission-Related Systems

If the delivered tuning file includes adjustments or deactivations to any of the following systems:

  • DPF (Diesel Particulate Filter)
  • EGR (Exhaust Gas Recirculation)
  • SCR/AdBlue Systems
  • OPF/GPF (Gasoline/Diesel Particulate Filter)
  • NOx Sensors
  • OBD Monitoring
  • Vmax Limiter Removal
  • Pop & Bang / Hardcut functions

…the customer confirms and agrees that:

  • The file will not be used within the jurisdiction of the European Union (as per Regulation (EC) No 715/2007)
  • The software will not be used in vehicles registered for road use under local vehicle regulations (e.g., StVZO in Germany or KFG in Austria)
  • The file is used solely for the purposes defined in Section 2

5. Liability Waiver

Alpha International Software Development LLC assumes no responsibility for:

  • Loss of vehicle registration or type approval
  • Technical defects or engine damage due to incorrect use
  • Fines, penalties, or legal actions resulting from non-compliant use
  • Any use of the file by third parties beyond the original customer

6. No Refund Policy

By purchasing, downloading, or receiving any file from Alpha International Software Development LLC, the customer confirms full understanding and acceptance of the above terms.

The client acknowledges and agrees that all fees are charged for the labor and expertise provided by our engineers, and not for the specific results of such work. While we will make every reasonable effort to deliver a high-quality product and provide ongoing support, all completed labor must be fully compensated. Accordingly, no refunds—whether partial or full—will be issued under any circumstances.

Prior to purchasing tuning credits, clients are advised to review the description and purpose of our file service. In the event that a selected tuning option cannot be completed, the corresponding credit will only be reimbursed to the client’s account balance for future file service use. Refunds to external payment methods are not permitted.

For vehicles not listed as supported, no guarantee is made that a suitable solution exists. If file modification proves impossible, the client will be informed that the service has been canceled and the associated credit will be returned to their file service account for future use.

Our support ticket system is intended solely for resolving issues related to the files and services we have provided. We are under no obligation to modify or correct files created by third-party tuners free of charge. The client will receive only the file and options that were explicitly selected and paid for.
